SMART CONTRACTS: OPPORTUNITY OR THREAT? A REVIEW INTERMS OF THE LAWYER PROFESSION
Advances in technology affect the discipline of law. This effect, on the one hand, reveals the need for new legislation with the emergence of new concepts and practices. On the other hand, the technological impact also changes the way of practising law in the legal profession. Smart Contract is a practice that emerged with blockchain technology, brings new applications in contract law and will be important in the establishment of debt relations in the future. Smart contract is created with computer codes due to their technological nature, and the actions that the parties undertake against each other are automatically fulfilled. This situation relatively prevents the emergence of contractual disputes. Lawyers present solutions suitable for the interests of the parties wherever there is a dispute due to their profession. However, the conflict-preventing feature of smart contracts reveals the threat that a dramatic end is approaching in terms of the future of the legal profession. Contrary to this view, it is thought that smart contracts will add value to the legal profession. It is foreseen that it will not be possible to establish smart contracts without lawyers, and with the increase in the number of lawyers who will learn coding language, there will be more qualified human resources in the profession.
