China Tightens Grip on Cryptocurrency Crimes with Landmark Case and New Guidelines




First Conviction in Crypto Crime Crackdown


China has taken a significant step in its fight against cryptocurrency-related crimes by securing its first conviction in a case involving the illegal acquisition of digital wallet private keys. The Xuhui District Procuratorate, alongside the Xuhui District Public Security Bureau, announced this landmark case as part of broader efforts to combat the rising tide of cybercrime linked to virtual currencies.

New Guidelines for Virtual Currency Crime Prosecution


In a bid to standardize the handling of cryptocurrency-related criminal cases, the Xuhui District Procuratorate and Public Security Bureau have jointly issued the "Guidelines for the Standardization of the Disposal of Virtual Currency Involved in Criminal Litigation." These guidelines provide a comprehensive framework for managing cases involving digital assets, from evidence collection and asset seizure to the secure storage and eventual disposal of virtual currencies.

Launch of Guangqi X Space for Cybercrime Research


To further bolster efforts against cybercrime, China has launched the "Guangqi X Space," a platform dedicated to addressing new forms of cybercrime involving artificial intelligence, big data, blockchain, and digital assets. This initiative, managed by the Xuhui District Procuratorate and supported by the Intelligent Procuratorial Research Center of the Shanghai Procuratorate, aims to serve as a hub for case management, knowledge sharing, and the development of effective legal strategies.

The Growing Threat of Cybercrime in China


According to Song Shanshan, head of the Xuhui District Procuratorate's cyber prosecution team, there has been a significant rise in criminal cases involving digital currencies over the past three years. These crimes are often well-organized, involve sophisticated techniques, and typically involve large sums of money, sometimes reaching millions of yuan.

In the country's first case of illegal acquisition of digital wallet private keys, three individuals were convicted of illegally obtaining 27,622 mnemonics, 10,203 digital wallet private keys, and 19,487 digital wallet addresses. The perpetrators had implanted a backdoor in a virtual currency wallet application, enabling them to access and exploit sensitive data. All three were sentenced to three years in prison and fined 30,000 yuan by the Xuhui District Court.

The introduction of new guidelines and the establishment of specialized platforms like Guangqi X Space are seen as crucial moves in curbing cybercrime in China's digital currency space. As cyber threats continue to evolve, these measures will play a key role in protecting users and maintaining the integrity of the virtual currency ecosystem.
