The team of lawyers defending the founder of Terraform LabsDo Kwon asked the US court to postpone the trial based on the indictment of the Securities Commission (SEC).
Specifically, after serving a 4-month prison sentence forfalsifying documents in Montenegro, Do Kwon faces extradition requests from both the US and South Korea. But as Coin68 reported on December 19, 2023, the Montenegrin court has rejected the extradition requestmentioned above, this controversial figure is temporarily not required by authorities to be present in the US or Korea.
However,SEC indictment is still there and the trial is expected to take place on the next January 29. The charges that Do Kwon is facing include:
- Fraud in securities offering activities;
- Fraud related to securities offering activities;
- Offering unregistered securities;
- Offering securities exchange contracts to ineligible individuals;
- Processing securities exchange contract transactions with ineligible individuals.
- 2 counts of conspiracy to defraud, 2 counts of securities fraud, 2 counts of wire fraud, property fraud and market manipulation related to LUNA and UST (United States Department of Justice).
Citing the reason that their client could not attend the trial on January 29, the lawyers participating in Kwon's defense asked the court to postpone the date to February or mid-March at the latest. At that time, Kwon will have can present themselves in court.
The request from the lawyer reads:
βIt now appears that Mr. Kwon will not be extradited until February or March at the earliest, so postponing the trial until mid-March will enable Mr. Kwon to attend in person."
If the above request is denied, meaning the trial will still take place at the same time, the lawyers ask the court to provide the jury with a notice detailing the absence and the reason for not being able to present. Kwon's testimony, with the most "objective possible" language, so as not to create any unnecessary bias on the part of the jury.
